Beanfly - Terms of Service

These terms govern your use of the Beanfly app ("the app"), provided by On The Ground Productions ("we", "us"). By downloading or using the app, you agree to these terms. If you do not agree, please do not use the app.

Your licence to use Beanfly

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use. You may not copy, modify, distribute, sell, or reverse engineer the app except to the extent this restriction is prohibited by law.

Your content and your device

Beanfly stores your shopping lists and settings on your device. You are responsible for your device and for keeping your own backups where you need them; because your lists are stored locally, uninstalling the app or clearing its data will remove them, and we cannot recover them for you.

Beanfly Plus subscriptions

What it is: Beanfly Plus is an optional paid subscription that unlocks extra features such as premium themes, mascot animations and supporter status.
Billing: subscriptions are sold and billed through your Google Play account. Prices are shown in the app before you purchase and include any applicable taxes.
Free trial: where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before it ends.
Auto-renewal: subscriptions renew automatically for the same period and price unless cancelled. You can cancel at any time in Google Play → Subscriptions; cancellation takes effect at the end of the current billing period.
Refunds: refunds are handled by Google Play in accordance with Google Play's policies.
Price changes: if we change a subscription price, Google Play will notify you and, where required, ask for your consent before the new price applies.

Acceptable use

You agree not to misuse the app, interfere with its normal operation, attempt to access it in an unauthorised way, or use it in breach of any applicable law.

Disclaimers

The app is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including as to fitness for a particular purpose or uninterrupted or error-free operation. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or any loss of data, arising from your use of (or inability to use) the app. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the app in the 12 months before the claim.

Changes to these terms

We may update these terms from time to time; the "last updated" date above will change. Continued use of the app after an update means you accept the revised terms.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, except where your local consumer law gives you additional rights that cannot be overridden.
